The interviewer wants your method for breaking down a complicated dispute. Describe issue-spotting against the elements of each claim and defence, a chronology and fact map tied to documents, a list of what you must prove and what you can prove, and early assessment of weak points. On predicting the other side, mention reviewing opposing counsel's previous filings and arguments, the judge's past rulings, and testing your case with a colleague arguing the other side. On oral argument, explain a clear opening, the strongest point first, dealing with your weakness before it is raised, and flexibility when the bench interrupts. For clients and juries, talk about plain language, analogies, visual aids and regular updates in high-stakes matters, including bad news delivered early.
